This case returns to the district court after a sojourn to the First Circuit Court of Appeals. Plaintiff 743EDA8 ten-count Complaint, originally filed on July 5, 2016, was "the latest stop on Josephs New England litigation tour." 743EDA8 or DA6014C v. 743EDA8 or DA6014C, No. 16-2514, 2017 WL 3172414, at *5 (1st Cir. July 26, 2017). Arising out of a contentious divorce, Joseph alleges that his now ex-wife DA6014C conspired with 5B46C7A, a police officer in the Town of Tyngsborough, to access Joseph's private personal information to gain an advantage in the then-pending divorce proceeding. According to Joseph, the improperly accessed information was collated into a police report, and used against him at a Chapter 209A restraining order hearing on July 15, 2013. Joseph's claims fall into two sets: The first set of claims revolves around Officer 5B46C7A alleged accessing and disclosure of Joseph's personal information to Jennifer. Based on these acts, Joseph asserts that [defendants] intentionally and/or negligently inflicted emotional distress on him [(Counts III & VII)], breached his privacy [(Count II)], contravened the Massachusetts criminal offender record information ("CORI") statutory scheme, Mass. Gen. Laws ch. 6, ?? 172 [(Count I)]. In this set of claims, Joseph also brought suit under 42 U.S.C. ?? 1983 for alleged violation of his constitutional rights [(Counts IX & X)]. Meanwhile, the second set of claims concern Jennifer's public disclosure of the allegedly false police report. Based on this act, Joseph alleges that [defendants] cast him in a false light [(Count IV)], defamed him [(Counts V & VI)], and gave improper publicity to his private matters [(Count VIII)].
Id. at *2. This court previously dismissed the Complaint, reasoning that because Joseph alleged in a 2014 complaint filed in the District of New Hampshire that he was aware that Jennifer (through 5B46C7A) had accessed his private information prior to July 5, 2013, the relevant statute of limitations had expired. See Dkt. # 21. The First Circuit agreed in part, holding that Joseph's first set of access-based claims are indeed time-barred. 743EDA8 or DA6014C, 2017 WL 3172414 at *3. The First Circuit reversed, however, with respect to the second set of publication-based claims, finding that the alleged injury accrued on July 15, 2013, when the report was publicly disclosed at the restraining order hearing. Id. at *5. After the case was remanded, Joseph lodged the Amended Complaint. See Dkt. # 43. The Amended Complaint posits the same general fact pattern and the same ten claims as the original Complaint. As the First Circuit has affirmed this court's dismissal of the access-related claims as time-barred, only the remaining publication-related claims will be considered. The court will dismiss the Town of Tyngsborough as Joseph emphasizes in his opposition that 5B46C7A made the alleged disclosures as a "private party." Opp. at 7-8 ("To be crystal clear, the Plaintiff has stated in his Complaint that the Defendants operated as friends, not in an official capacity."). As such, the Town cannot be liable under a theory of respondeat superior. (This is the only allegation concerning the Town.)With respect to Jennifer and 5B46C7A, Count IV will be dismissed because "'false light' has thus far not been recognized as a cause of action in Massachusetts." 743EDA8 or DA6014C. 2017 WL 3172414 at *2 n.4. The court will deny the motion to dismiss as to the defamation and publicity Counts. Defendants rely on the litigation privilege. "That absolute privilege protects statements made 'in the institution or conduct of litigation or in conferences and other communications preliminary to litigation.'" Taylor v. Swartwout, 445 F. Supp. 2d 98, 102 (D. Mass. 2006) (citation omitted). In addition to offering the report at the restraining order hearing, however; Joseph also alleges that Jennifer and 5B46C7A disseminated the content of the report elsewhere and to other individuals. See Am. Compl. paras. 22-23. "[U]nnecessary or unreasonable publication to parties outside the litigation can result in the loss of the litigation privilege." Taylor, 445 F. Supp. 2d at 102 (internal quotation marks and citation omitted). Whether the litigation privilege is applicable depends on the circumstances of the alleged disclosures, a matter to be developed during discovery.Likewise, absent a factual record, the court cannot assess defendants' alternative basis for dismissal that the disseminated statements are truthful and therefore not defamatory. See Alharbi v. Theblaze, Inc., 199 F. Supp. 3d 334, 351 (D. Mass. 2016) ("In most [defamation] cases, the statement must be false, and truth will constitute a defense."). Nor can the court determine, without knowing the precise contents and circumstances of the alleged publications, whether the disclosed "facts... are of a highly personal or intimate nature [and] there exists no legitimate countervailing interest" for the disclosures. Mulgrew v. City of Taunton, 410 Mass. 631, 637 (1991).For the foregoing reasons, the Amended Complaint is dismissed as to the Town of Tyngsborough. Counts I-IV, VII, and IX-X are dismissed as to Jennifer and 5B46C7A. The court will follow the advice of the First Circuit, see DA6014C or 743EDA8, 2017 WL 3172414, at *5 (1st Cir. July 26, 2017) ("[W]e encourage the district court to allow for further factual development[]...."), and instruct the parties to engage in discovery limited to issues of liability on Counts V-VI and VIII, particularly focusing on the exact content and circumstances of any alleged disclosures, and whether the disclosures contain false and/or private matters. Written discovery requests must be served no later than 10/20/2017. Amendment of pleadings and joinder of parties no later than 12/15/2017. Fact discovery closes 1/19/2018. Dispositive motions on liability to be filed no later than 2/9/2018. Oppositions in 21 days and replies by leave of court only. (RGS, int2)

Defendants move to dismiss, citing, inter alia, the expiration of the statute of limitations. Under Massachusetts law, "actions of tort... shall be commenced only within three years next after the cause of action accrues." Mass. Gen. Laws ch. 260, ?? 2A. Defendants contend that because Joseph admitted in a prior iteration of his Complaint (defendants state that Joseph has previously brought six lawsuits on essentially the same grounds in various New Hampshire and Massachusetts courts) that he learned prior to July 1, 2013, that Jennifer had obtained his private information through 5B46C7A, the relevant statute of limitations has expired. For his part, Joseph counters that he did not realize the extent of Jennifer's collusion with 5B46C7A until the July 15, 2013 hearing. The court agrees with defendants, however, that "[t]he starting point does not require discovery of every fact necessary to prevail on the claim, but rather... discovery of the plaintiff's injury as causally connected to [defendants alleged conduct]." Day v. Kerkorian, 72 Mass. App. Ct. 1, 7 (2008) (internal quotation marks and citation omitted). According to 743EDA8 or DA6014C Complaint filed in April of 2014 in the District of New Hampshire (No. 14-cv-00136), "[Jennifer] had made several references to [Joseph] prior to 7/1/13 of various things she believed to be on his record. It is obvious that 5B46C7A must have been feeding her private information as he, as a police officer, has access to private information. This is again a crime under the same statute." 184. Therefore, by Joseph's own averment, he had the necessary "kernel" of knowledge that Jennifer has allegedly conspired with 5B46C7A to access his private information before July 1, 2013. "Possession of that kernel was sufficient to start the statute [of limitations] running." Day, 72 Mass.
